We strive to provide excellent service every time you interact with us, and to do so, we may need to utilise some of your Personal Information. This Privacy Policy explains how we handle the Personal Information we collect about you and/or receive from you. By using our Platforms, you consent to the processing of your Personal Information as outlined in this Privacy Policy.

Terms

In this Privacy Policy, the following terms have the meanings as set out in POPI:

  • "Personal Information", "Special Personal Information" and "process / processing."

  • "we", "us" or "our" refers to nu.

  • "you" and "your" refers to any individual accessing or using our Apps.

  • "food" refers to food, beverages, and other items available from the restaurants or coffee shops listed on our Apps.

  • "registered individual(s)" refers to individuals who have registered on our Apps, provided a unique email address via Apple or Google, and submitted other Personal Information in order to use our Apps.

  • "restaurants" refers to the restaurants, and coffee shops listed on our Apps.

Personal information about you we collect and process

nu processes Personal Information reasonably and for specific purposes. In order for individuals to access and use our Apps, we collect and process certain Personal Information. When you become a registered individual, we need to collect and process your Personal Information to provide one or more of our services to you.

When you register to use our Apps, we may collect the following Personal Information:

  • Name and surname

  • Identification number

  • Date of birth

  • Email address

  • Mobile phone number

  • Allergies

If there are any changes to your Personal Information or if you wish to amend or correct it, you can update your registered individual information in your profile.

By providing your Personal Information, you acknowledge that the information you have provided is accurate, current, true, and correct. You also acknowledge that you are not impersonating or misrepresenting any person or entity, and you are not falsely stating or misrepresenting your affiliation with anyone or anything.

Digital information about you we collect and process

When you access our Apps with or without being a registered individual, nu processes some of your Personal Digital Information. Depending on how you access and use our Apps, we may receive:

  1. Information about the device you use to access or use our Platforms, including the device make and model, how you access our Apps, your IP address, and your browser or operating system.

  2. The location from which you accessed our Platforms, including the signal from your device's GPS and information about nearby wifi networks and cell towers. We collect this information when you use location-enabled services.

  3. Other information about you from social media platforms and other third parties.

  4. Log information, including online identifiers, such as information about:

    1. How, when, and for how long you use our Apps.

    2. The Food items you view.

    3. The Food items you search for.

    4. The Restaurants you dine at.

How we use / process information we collect

Primarily, we process the Personal Information we collect and receive for the following purposes:

  1. Identifying you.

  2. Verifying your identity.

  3. Creating an individual account (profile) for you.

We also process your Personal Information for the following purposes:

  1. Complying with legal or regulatory obligations, such as tax or financial laws.

  2. Fulfilling our contractual obligations to you when you order food at a restaurant. This includes processing personal information related to bill splitting with and ordering food for other registered individuals.

  3. Communicating with you regarding our Apps, in order to provide information about payments, customer support and complaints.

  4. Notifying you about changes to our Apps, products, terms and conditions, privacy policy, or any other notices that may affect you.

  5. Obtaining feedback from you to help us improve our Apps, products and business.

  6. Providing you with requested information, products, or services.

When you access and use our Apps, we may utilise various technologies, such as cookies and / or interaction tracking, to enhance your experience on our Apps. This data allows us to improve the functionality and usability of our Apps and personalise your experience. We may use this data in the following ways:

  1. To enhance the user-friendliness of our Apps.

  2. To customise your interactions with our Apps.

  3. To ensure compatibility with your device(s).

  4. To deliver targeted advertising that is relevant to you, controlling the frequency of ads you see, and measuring the effectiveness of advertisements on our Apps and other websites based on your online activities, such as the websites and apps you use or the content you view, in combination with the information we have about you.

  5. To send marketing communications (that you can opt out of), if you are not a registered individual.

We will not use your Personal Information for any other purpose without your explicit consent.

Disclosure of information we collect

We do not and will never sell your personal information to third parties for marketing or any other purposes.

We may share or provide access to your Personal Information with:

  1. Our employees, and third-party service providers who assist us in interacting with you through our Apps for marketing, ordering, and payment.

  2. Restaurants to prepare and serve the food you ordered, and if applicable, process returns.

  3. Law enforcement, government officials, fraud detection agencies, or other third parties when necessary or appropriate to investigate fraud, intellectual property infringements, or other illegal activities that may expose us to legal liability or financial loss.

  4. Service providers contracted by us who assist in various aspects of our business operations (fraud prevention, marketing, technology services, etc.). These service providers are obligated to use your Personal Information only for the services they perform for us and not for their own benefit or any other purpose, and they must treat the information as confidential.

Transferring of information we collect outside of South Africa

For the purposes described above, we may transfer specific Personal Information to service providers situated outside of South Africa's geographic borders. This may involve data processing, data storage, and data backup to uphold the security of our systems. When we transfer your Personal Information outside of South Africa, we will adhere to the lawful transfer regulations outlined in POPI.

By accessing and utilising our Apps, you provide your consent for the transfer of your Personal Information outside of South Africa as stated in POPI.

Retention of information we collect

We store your Personal Information for the following durations:

  1. As long as it is necessary to provide our Apps, products, or services to you.

  2. In compliance with applicable laws and our internal retention policies.

  3. To uphold the contractual agreement between you and us.

  4. If you have given consent for us to retain your Personal Information, subject to your request for us to cease processing it.

We will retain your Personal Information for as long as required to fulfil the purpose for which it was collected or subsequently processed. If your Personal Information serves multiple purposes, we will retain it until the purpose with the longest duration expires. However, once the duration for a specific purpose expires, we will cease using your Personal Information for that purpose.

By accessing and utilising our Apps, you provide your consent for us to retain records of your Personal Information for no longer than necessary to fulfil the purpose for which the information was initially collected or subsequently processed.

Deletion, correction and access to information we collect

Once you have provided sufficient evidence of your identity, you, as an individual, are entitled to the following rights:

  1. View, correct, and/or update the Personal Information nu processes about you. If you are a registered individual, you can do this through your user account, where your Personal Information is displayed.

  2. Request a record of your Personal Information. Please note that nu may charge a fee for providing this record. In cases where access and amendment requests are unfounded, excessive, or repetitive, nu may charge an additional administrative fee or refuse the request.

  3. Request the correction, destruction, or deletion of your Personal Information. If you no longer wish to be a registered individual, you can cancel your account. However, please note that nu will retain your Personal Information as required by law or our internal retention policy.

  4. Be informed if we are unable to agree on whether to correct or delete your Personal Information as requested.

  5. Be notified, if reasonable, of any changes made to your Personal Information that may impact decisions made about you.

  6. Expect nu to comply with your requests upon receipt, unless there is a valid reason preventing us from doing so. As well as receive notification of the actions taken by nu in response to your requests.

  7. Be informed of any unauthorised access to your Personal Information.

  8. Request reasonable evidence of our compliance with our obligations under this policy, given reasonable notice and request.

  9. Submit a complaint to the Information Regulator.

Complaints

If you believe that we have used your personal information in violation of applicable laws, you agree to first try to resolve any concerns with nu. You can email your concerns to our team at legal@lyfebegins.com.
